Judge Priscilla Owen confirmed 56-43
After a cloture vote of 81-18, a vote to end debate and move on to the confirmation vote, Judge Priscilla Owen was confirmed by a 56-43 vote. Sen. Minority Leader Harry Reid on May 19th said;
If she makes law from the bench the Dems should love her. Two Dems did vote for her while 1 Republican voted against. The outcome really is no surprise, she always had the votes even before this filibuster fiasco. An interesting note is the Sen Robert Byrd voted for Owen along with Sen. Mary Landreau. Sen Lincoln Chafee voted with the Dems, as he usually does.
The real fun begins now. Sen Bill Frist has brought John Bolton's nomination to the floor for a vote. Reid has theatened a filibuster against Bolton in which he will probably claim that the agreent by the "Gang of 14" only applied to judges. Well if they filibuster Bolton, and even if they don't, Frist should bring to the floor one of the judges who was not involved in the deal and force the The Nitwit Seven (credit to Rush) to vote either with the Dems or with their party. It should be very interesting to see what happens.
In case after case, Justice Owen's record marks her as a judge willing to make law from the bench rather than follow the language and intent of the legislature or judicial precedent.
